Personal Injury & Property Damage Compensation

Mark McAuliffe has extensive experience in the pursuit and management of claims arising from accidents.

Personal injury claims can arise from work place accidents giving rise to workers’ compensation and damages for negligence. Injuries can also occur in motor vehicle accidents and on other persons’ property.

Mark McAuliffe has been involved in many hundreds of claims over many years both in the dispute of compensation for injured persons and in the defence of claims for those alleged to be responsible.  Our experience extends from all aspects of management of the claim through to the conduct of litigation should it be necessary to do so.

Property damage claims can be as difficult to manage as personal injury claims.  Be it the loss of property through a fire, like the Margaret River fires in 2011, motor vehicle damage from traffic accidents, damage from wondering livestock or property damage from whatever cause we can assist you.

Often difficulties arise between our clients and their insurers and we are happy to assist our clients in ensuring that adequate compensation is provided under the terms of insurance policies.

At Peter May McAuliffe Legal we understand the difficult financial circumstances of injured persons. We can arrange deferment of fees until settlement, in appropriate cases.

Motor Vehicle Accidents

Mark McAuliffe has extensive experience in the pursuit and management of claims arising from motor vehicle accidents. Mark has previously acted for many of the insurers operating in Western Australia, including the Insurance Commission of Western Australia. Mark now acts for claimants against the Insurance Commission of Western Australia, where those claimants have sustained an injury in a motor vehicle accident.

Ensuring adequate compensation can be a complex issue. It is not just your pain and suffering that you are entitled to be compensated for. We can assist you in recovering lost wages, including potential wages that you may lose in the future, if you have not fully recovered from your injuries. We ensure that you receive full reimbursement for all expenses that you have incurred, and may incur in the future. Many persons have to have family and friends assist them during long periods of convalescence. Did you know that there is a specific claim to recover for the value of that assistance, even though you have not had to actually pay for it?

We assist you in the lodging of your claim, through the negotiation process, to a successful settlement of your claim. If the matter requires resolution through the courts, we will attend to all court matters on your behalf, up to and including trial. In suitable cases, we offer a no-win, no-fee arrangement. Generally, no fees are payable by you until the successful conclusion of your claim.

Criminal Injuries Compensation

Did you know that if you are injured as a result of a criminal act by another person that you may be entitled to compensation?  In Western Australia there is a statutory scheme to provide compensation to injured persons in such circumstances.  Whether it is an assault by a stranger, domestic violence in the home, psychological trauma as a result of being involved in or observing a criminal act, you may be entitled to compensation under the Criminal Injuries Compensation Scheme.

At McAuliffe Legal we have many years of experience in assisting our clients obtain the compensation to which they are entitled.  We can assist you in the process of gathering the relevant evidence and putting forward your claim for assessment by the criminal injuries compensation assessor.  We have a detailed understanding of the requirements of the legislation and the evidential needs to support your claim.  We can assist you through this process to obtain the maximum compensation that is payable to you.

Your first consultation is free if you do not proceed.  In appropriate cases we can defer the payment of fees until your settlement is received.  Contact us today for your initial no obligation consultation to determine your rights to compensation.
