Corporate Advice
The statutory regime for the operation of companies in Australia is heavily regulated.
In addition to the provisions of the Corporations Act, there are numerous Court decisions that assist in interpreting the legislation and determining the conduct of companies.
At Peter May McAuliffe Legal we can advise our corporate clients and their office bearers and shareholders upon their statutory obligations and the appropriate operational procedures and legal requirements for companies. Noncompliance can lead to serious losses for a company. Significant fines can be imposed not only upon the company but also upon its office bearers.
Many office bearers overlook the personal risk that can arise if a corporation does not comply with its statutory obligations. In some circumstances, such as whilst trading insolvent, or through the non-payment of various taxes, office bearers can be found personally responsible with devastating consequences.
Having a clear understanding of your rights following a clear explanation of relevant laws by Peter May McAuliffe Legal can assist you in avoiding such pitfalls.
Corporate Governance
Corporate governance is not mere compliance with strict statutory provisions. There are established practices for the management of companies and the conduct of orderly meetings. There are recommended practices to be followed by office bearers and employees of companies to minimise their risk in the management of a company.
These risks are not merely noncompliance with statutory provisions. They are also commercial risks that relate to the operation of the business. Having a clear understanding of appropriate corporate governance practices helps to maximise the opportunities for your business and its financial success.
At Peter May McAuliffe Legal we can assist you in understanding the appropriate practices and procedures that you should adopt to maximise these opportunities.
